Can I Get a CPL With A DUI?

A DUI conviction will result in a suspension of your concealed pistol license. A DUI conviction will also prevent you from eligibility for a CPL if you don’t have a CPL already.

How Long is the CPL Suspension for a DUI?

Not all DUI convictions are treated the same for purposes of a CPL suspension.

A conviction for operating while intoxicated is an 8-year CPL suspension.

A conviction for operating while visibly impaired is a 3-year suspension.

What’s The Difference Between Operating While Intoxicated v. Operating While Visibly Impaired?

All CPL suspensions for misdemeanor convictions are broken down into either 3-year suspensions or 8-year suspensions.

The types of misdemeanors that result in 8-year CPL suspensions are “more serious” than those misdemeanors that result in 3-year suspension.

Both operating while intoxicated (OWI) and operating while visibly impaired (OWVI) are types drunk driving charges.

OWI is where a person had a blood alcohol content of .08 or over or was under the influence of alcohol at the time of driving. OWVI is where a person was drinking and driving with less care than the ordinary driver. It’s a matter of degrees. Often a person is charges with OWI. In many districts, a standard plea bargain resolution to this charge would be a dismissal of OWI with a guilty plea to OWVI.

Can I Expunge a Drunk Driving Conviction to Shorten a Suspension?

Drunk driving charges cannot be expunged. Again, a conviction for OWI will result in an 8-year suspension. For charges that result in an 8-year suspension, an expungement may cut that suspension period short.

An expungement may cut the suspension period short for eligible 8-year suspension misdemeanors. An expungement is where a conviction is erased through filing a motion. An expungment can be requested five years after either probation or incarceration for a conviction has passed. An expungement would erase a conviction that resulted in a CPL conviction. So you can see that getting an expungement might speed up your ability to get a CPL after a conviction.

However, operating while intoxicated charges cannot be expunged. Therefore, no expungement will cut the suspension period short for a conviction.
