Michigan Drug Use Laws

The penalty for drug use varies depending on the type of drug used. In general, a person may not use a controlled substance except with a valid prescription.

Use of

  • Any Schedule 1 or 2 narcotic
  • Cocaine
  • Ecstasy
  • Mathamphetamine

Is a misdemeanor, punishable by up to 1 year in jail, a $2,000.00 fine with costs, or both.

Use of

Any schedule 1, 2, 3, or 4 substance not listed above is a misdemeanor, punishable by up to 1 year in jail, a $1,000.00 fine with costs, or both.

Use of

  • LSD
  • Mescaline
  • Peyote
  • Pscilocyn
  • Pscilocybin
  • Dimethyltriptamine
  • A schedule 5 substance

Is a misdemeanor, punishable by up to 6 months in jail, a $500 fine with costs, or both.

Use of

  • Marijuana
  • Catha Edulis
  • Salvia Divonorum
  • Synthetic Cannabinoids

Is a misdemeanor, punishable by up to 90 days in jail, a $100.00 fine with costs, or both.

Inhalant Use

The use of solvent chemicals (glue, nail polish, gasses) for intoxication is a misdemeanor, punishable by up to 93 days in jail, a $100 fine, or both. MCL 752.272.

Drug Overdose Exception

The law creates protections to persons suffering from a drug overdose who present themselves at a hospital for treatment. The law also protects any persons helping the overdosing person. The evidence must show that the person only had drugs in the amount for personal use and the evidence of drug use must come from the fact the person went to the hospital.

Parental Notification

A health facility must notify the parents or guardian of an individual under 18 who presents to the hospital and is incapacitated. The health facility must obtain consent from the individual under 18 before contacting parents or guardian where the person arrives at the facility for non-emergency treatment.
