What Are the Penalties For Drug Dealing?

The potential penalty for manufacturing drugs, dealings drugs, or possession with intent to distribute drugs depends on the type of drug and the amount of the drug involved.

Schedule 1 or 2 Narcotics or Cocaine

Less than 50 grams is a felony, punishable by;

  • Up to 20 years in prison
  • $25,000.00 fine, or both

50 – 450 grams is a felony, punishable by;

  • Up to 20 years in prison
  • $250,000.00 fine, or both

450 – 1,000 grams is a felony, punishable by;

  • Up to 30 years in prison
  • $500,000.00 fine, or both

Over 1,000 grams is a felony, punishable by;

  • Life in prison or prison for any term of years
  • $1,000,000 fine, or both

Ecstasy and Methamphetamine

A felony, punishable by up to 20 years in prison, a $25,000.00 fine, or both

Any Other Schedule 1, 2, or 3 Controlled Substance Except Marijuana

A felony, punishable by

  • Up to 7 years in prison
  • A $10,000.00 fine, or both

Schedule 4 Substances

A felony, punishable by

  • Up to 4 years in prison
  • A $2,000.00 fine, or both

Schedule 5 Substances

A felony punishable by

  • Up to 2 years in prison
  • A $2,000.00 fine, or both

Marijuana

Less than 5 kilograms or fewer than 20 plants, is a felony, punishable by;

  • Up to 4 years in prison
  • A $20,000.00 fine, or both

5 – 45 kilograms, or 20 – 200 plants, is a felony, punishable by;

  • Up to 7 years in prison
  • A 500,000.00 fine, or both

More than 45 kilograms, or more than 200 plants, is a felony, punishable by;

  • Up to 15 years in prison
  • A 10,000,000.00 fine, or both

Prescription Form

A prescription form or a counterfeit prescription form is a felony, punishable, by;

  • Up to 7 years in prison
  • A $5,000.00 fine, or both

Sentencing

A term of imprisonment may be imposed to run consecutively with any other term of imprisonment for the commission of another felony. Second or subsequent convictions for drug dealing can result in higher sentences.

In a felony prison sentence, a person receives a minimum and maximum sentence. The minimum sentence a person actually receives depends on a combination of variable including a person’s prior record and the specifics of the sentencing offense. The maximum sentence is set by law.
