Defense of Non-Citizens
Ann Arbor Criminal Defense Lawyer Defends Non-Citizens
At ArborYpsi Law, our Ann Arbor criminal defense lawyer practices the criminal defense of non-citizens. A criminal conviction for a non-citizen can result in deportation. For the non-citizen charged with a crime, the immigration consequences of a conviction are often more severe than the criminal penalties. As a result, the goals of the representation become more focused on the impact that a conviction will have on immigration status.
Getting the Right Results for Non-Citizen Clients
The reality for non-citizen clients in criminal cases is they cannot afford to enter a plea. Any plea at all could result in deportation or at least put their immigration status in jeopardy. In these cases, we go for the dismissal or fight aggressively, because there are no other options. The case must be put on a track to allow for the greatest possible chance of winning through proactively challenging the case. For example, in felony cases we will be running the preliminary examination and filing motion, setting the case up for the greatest chance of success through the challenge.
In other cases, a quiet resolution with a plea bargain to the right resolution is more important than fighting the case. For example, we might shoot for a resolution in a plea form to a charge like disturbing the peace or disorderly conduct so that immigration status is kept intact as much as possible. At the outset of your case we will evaluate the situation and potential outcomes as they relate to immigration status and work accordingly.
Experience Working For Non-Citizen Clients
We have worked on behalf of many clients who had immigration concerns. What we often do is work directly with immigration lawyers when representing clients with immigration issues. This way we can ensure that our clients know that they can move forward in the case confidently and that immigration concerns are at the forefront.
